Your rights in Portugal
Agencies must print their AMI licence number on their office, website, ads and contracts. No number, ask why.
If you hire an agency, the contract must be in writing and state the fee, VAT and the agency’s insurance.
An agency can’t charge the seller and you a fee on the same deal. If they want both, walk away.
Money you hand an agency before the deal must be kept, not used, and given back when you ask for it.

Questions
Find the agency’s AMI number on its website or ads, then search it in the official IMPIC register. The company name that comes back should match the legal name on the agency’s contract, which is often different from the brand on the door.
Whoever signs the brokerage contract pays the fee written in it. By law an agency can’t take a fee from both the seller and the buyer on the same sale.
Only if it holds a Portuguese AMI licence or is registered with IMPIC as an agency from elsewhere in the European Economic Area. Individual consultants work under their agency’s licence, so it’s the agency’s number you check.
They can ask, but it’s optional. If a contract is exclusive it has to say so and explain what that means. As a buyer you can talk to as many agencies as you like.
